interesting product, it is basically a weighted spring valve. the theory is when airflow reaches a certain velocity it will be fully open. the fact that it will be fully open means that it will probably not be any quieter at high revs so probably no good for track days. (maybe a bit because it is still a slight blockage, depends how many dB's you're trying to shave off.)
probably be quite a lot quieter at low revs mooching around town and you'll get less evil stares from old ladys and the police

i would be suspicious of the affect it may have on throttle response etc, it all depends on the spring load and one would hope Apexi being a big company have done some serious airflow testing!

people are gonna forget it's closed, put pedal to the metal, hit high revs and who knows what might happen, the car might stall/freak out or it might go BOOM?
there are electronic ecu controlled valves and vacuum controlled valves:

a lot of research goes in to exhausts and airflow and noise on powerful cars because by default they are loud! For the sake of argument a V12 is 3 times louder than a 4 cylinder... Some employ vacuum or electronic controlled valve systems like in that picture. I would suggest they mainly do it to comply with EC Type Approval driveby noise levels. The magic 'sport' button that clarkson always presses will fully open these valves and all hell breaks loose
Technically speaking your exhaust noise levels would probably be illegal with this button pressed!?!? (small print will probably say 'not for road use')
