So i bought some wheels off ebay and used paisley freight to collect them (they subbed it out to apc) and i paid an extra 15quid for up to £250 insurance.

They didn't collect the day they were supposed to but did the next afternoon after i emailed them. They then turned up in the next few days except there were 3, my dad took them in and the delivery driver came to the door with 2 then asked if thats it he said oh yer got another. I then emailed them saying its missing and i didn't get a reply and i did try ringing but its two crappy mail box numbers that never get answered. I did get through the next day and the woman said they'd emailed me but just so happens the email comes through while im on the phone hmmm. She wanted pictures of the packaging from the seller wtf why would they have pictures? Anyway i sent them a picture of the wheel and delivery label which was last friday and have still had no reply. I emailed again last wednesday that i have had no reply and unhappy with the level of service. I have had no reply again and no one picks up the phone or it stops ringing and saids mailbox is full.

My dad signed for them on apc's digital signing tablet but he wasn't to know there was more than three wheels. Annoying thing is i have cctv but the way he parked is just off screen. I paid insurance but as he signed where do i stand?

Thanks

You stand on pretty rock solid ground to me mate,
You bought 4 wheels (ebay proof), you paid for 4 wheels (ebay/paypal/bank acc proof), the seller shipped 4 wheels (his written account) but they only delivered 3 (your written account)

Signing to say a 'parcel was received' is totally different to inspection and signing off the goods 'as described'.

This company sounds like they are only going to fob you off so i would write to them )once only) and make it crystal clear what you want and by what date you want it and if it doesn't happen you'll issue a summons at the county court for full compensation plus costs, plus fees.
Once a summons is dropped on their doormat they tend to take you a bit more seriously.

Make sure you only deal with the initial  company responsible, not their sub contractirs because Your 'contract' is only with them. Very Happy

Wouldn't the issue be with the seller?
Was each wheel packed separately and a label put on each wheel.
Or was a label just put on one wheel and said it comes as a set?

If the seller took pictures of the parcel even better for him to send you.
I always take pictures of the parcels and labels I send out.

Have you confirmed with the seller definitely 4 wheels he sent?

Hope it's all sorted.

Use to use APC overnight a lot back in the day, they where okay.

Just re read, you arranged your own collection not the seller posting. So it's between you and the delivery/ collection company now.

Read section 9 carefully

Yes i arranged the courier and it was wrapped up by the seller and 4 were collected. I'm missing 2of4, i've used hermes a few times and they've been pretty bad at collecting and delivery so i stopped using them but this is a first with paisley. Pretty annoying as i'm out of pocket with three wheels but its good that it sounds like i have some sort of stand point. I will have to try citizens advise

You have to be carefull some places state you sign for it as damaged if you don't check it but yet drivers don't want to wait while you check and don't take kindly to you sayin ok but I am not putting my name to it or I will but as damaged

I had a look at the paisley freight terms and it does say about the signing as damaged.
But then they should have some sort of digital receipt that shows three parcels and not four?
I will have to get some help to write a formal letter as i will get no answer from them. Maybe they have me on call and display so know not to answer hmmm

They will have a record that only three was delivered unless the driver did a crafty one by puttin four parcels on the scanner and got you to sign. You should always check how many parcels you are signing for as it will say something along the lines of "you are signing for 3 parcels" on the screen near the box you sign in. The reason I know this is I'm a driver for yodel and yes we get this sort of situations all the time. Sometime the parcels can be down as a split consignment saying 1/4, 2/4 and so on but they are not necessarily kept together at the sorting office. We have miss orated parcels all the time and I get customers saying where's my other one but they usually get it from a day to a week later depending on the sort centre.

Probably the best thing you can do is claim on the insurance and it will most likely turn up after that

I've sent another email with a link to a new wheel or find it
Or pay out the insurance or i'm going to take it further.
I'll give them another ring tomorrow to ask if they got it and if they start getting angry well i'll have to go to citizens advice and get something written up.

Wish i'd just bought wheels from driftworks in the first place.

Amazingly paisley freight have pulled there fingers out maybe it's because i've asked for insurance money. I told them where to deliver it to and i hope they don't lose it this time around.

You will find it was put on the wrong pallet at their national hub and sent to somewhere else in the country and they have had to check video at the hub and then track where all the shipments went from that lorry that was tipped at the hub.
Would have been nice if they explained this to you tho.
I worked at a hub a few years ago and we would get through 16000 pallets a night.
