I will keep this as short as possible.

My mate part exd an audi rs6 about 6months ago for a Volkswagen toe rag.

He got arrested the other day on suspicion of theft and burglary, turns out the audi filled up with petrol and didn't pay and then went on to be involved in a burglary.

Somehow the car was still in his name. This is not the biggest problem though.

The Volkswagen broke so he decided to sell it to a breakers yard. They rang up a week later and said the car had finance on it and the finance company are taking the car back.

When my friend bought the car the guy gave him the paperwork with a hpi check which said it was all clear.

What will happen to my friend? Will he have to pay back the 3k he sold the car to the breakers yard for? Will he have to pay back the finance which he said is 10k?! And if so he can't afford to pay it all back in one go so how will that work? Will he have to go to court or worse prison?

I have told him to get legal advice

I dont think he will get collared for the hpi as he isnt the original if he can prove point of sale etc i nearly got done myself when the car i sold was involved in a accident i managed to get a v555 form from dvla to prove i wasnt the owner .... i would defo seek legal advice ... and wouldnt pay any money to anybody ... as this will mean he accepts responsibility for it ...

Breakers yard might not be the most patient people.
As for the audi surly its up to the police to prove he was driving as much as it is him to prove he was not. But i know the police they dont work like that

My insurance company was not sympathetic along with the police they both told me i was guilty and was down to me to prove otherwise .... has he not got a p.o.s ..???

I'm not sure. I probably wouldn't have after the car had been gone for.nearly 6 months. I've told him not to pay anything and he is.going to get legal advice. Who is responsible for the finance? The person.that took it out or the owner? Coz.if.It's.the owner it's now.the breakers yards problem as they've had.it.at.least a week

Point of sale ..... a reciept of sale wich is signed by both keeper and new keeper ...dated  etc this is what insurance companys and police  request wich then can be later confirmed on the police  and insurance  database ...

When ive seen it on the telly the person who owned the car where the previous owner had finance they come took the car away and that was it ....

Yes coz then they will sell it on and get money back that way and person that took out the finance will get a bad credit rating I suppose.
That won't be so bad for my mate. Don't know what the breakers yard will do about getting there money back

Tell him to go see cab aron as they will know for sure the legalities of it all.
At the end of the day I would have thought the tourean will be collected by the finance company as it's technically still their property, everyone that's been passed the car has had it unknowingly that finance was outstanding so I would guess it will be the guy that had the finance initially who they may come after

As for the rs6 .........just tell him to give the guys name who he took the tourean from in px, in other words pass the buck

The most important things here.

1. Time of robbery/ theft who's name was the V5 in?
2. Time of finance who's name was the V5 in?
3. Do you have a transaction note, or any record to provide evidence of sale? Then if so who was the owner at the time?
4. You can even do a hpi and it can show the finance company details. Ring them up and they could provide details of who's name the finance is under.

If you can provide details to the above that puts you out the frame, you will be fine.

If you can't then it's to court, fines, ccj's, or even prison. Sad

The car should not have still be in his name if he posted out the log book under the new keepers name and gave them the green/ yellow slip.
If he just handed them the whole logbook then more fool him sorry.
